内容摘要:近年来我国纺织产业发展较快,外贸出口增幅迅猛。2006 年我国纺织业在继续 面对欧美配额压力的同时又受到国际企业社会责任运动的挑战,本文分析了企业社会责任运 动的趋向,研究新环境对中国纺织品出口的作用机制,尤其是其中的制约性因素。并在此基 础上提出中国纺织业应对企业社会责任的策略建议。 关键词:纺织产业 外贸环境 企业社会责任 挑战 策略

国际社会正在日益兴起和发展的企业社会责任运动,对中国企业和政府都是一种挑战,企业 社会责任(Corporate social responsibility,以下简称 CSR)不仅是一个企业为什么存在的使命 题目,也是中国企业在全球经济一体化过程中所必须面对的一个现实题目;它不仅是软性的 人文道德的呼吁,而且是刚性的制度约束;它不仅是一种理念,更是一种实践。
国际企业社会责任建设的新形势
当今世界,不仅发达国家将劳工标准与国际贸易和对外投资挂钩,而且消费者和投资者 都非常关注跨国公司的劳工题目,他们分别运用“良心购买权力”和“良心投资手段”,对跨国 公司施加巨大影响。据报道,仅 1999 年,美国的道德投资额就超过了 2 万亿美元。与此同 时,非政府组织、大众媒体和社会公众也对跨国公司的劳工题目紧盯不放,经常采取“***”、 “***”等方式,迫使跨国公司及其在发展中国家中的合约工厂放弃“血汗工资”、“血汗工厂” 的谋利手段而弃恶从善。迫于消费者日益增大的压力,面对日益激烈的市场竞争,很多欧美 跨国公司都制定了各自社会责任守则。同时,很多行业性、地区性、全国性乃至全球性的行 业组织和非政府组织也制定了各不相同的守则。据 ILO(国际劳工组织)统计,目前这样的 守则已经超过 400 种。
近几年来,大多数欧美跨国企业都对其全球供给商实施 CSR 评估和审核,只有通过评 估和审核,才能建立合作伙伴关系。CSR 开始越来越多地出现在跨国公司订单的附加条件 中了。到 2000 年,全球共有 246 个 CSR 生产守则,其中比较有影响的生产守则制定和监察 认证组织有美国“国际社会责任组织(SAI,SA8000 的制定者)”、“公平劳工协会(FLA)”、 英国“道德贸易行动(ETI)”、荷兰“洁净衣服运动(CCC)”、国际玩具商协会(ICTI)、环 球服装社会组织(WARP)等。而 SA8000 的构思突破了传统的守则形式,把非经营性、非 技术性的抽象的道德、精神和理念等指标化,成为衡量企业的道德指数。因此,推出后逐渐 被企业和社会所接受。
目前,SA8000 正处在发展过程中。从行业方面看,主要集中在服装、纺织、玩具、化 妆品、家用器皿、化工、食品等行业,其中服装、纺织和玩具是最主要的三大行业。据制定 SA8000 的 SAI 网站上截至 2005 年底的统计数据显示,全世界通过 SA8000 认证的 881 家企 业当中,纺织服装企业有 220 家,占 24.9%,在通过 SA8000 认证的中国 119 家企业当中,

纺织服装有 55 家,占 46.2%。从适用的组织类型看,目前主要是生产型企业、专业的贸易 公司,但已经开始向咨询、服务企业以及政府部分扩展。不可否认的是,SA8000 在世界范 围内的快速推行给我国纺织业一个强烈的启示:企业社会责任从来就发挥着很重要的作用; 随着国际贸易一体化进程的加快,企业社会责任将会作为发达国家抵制发展中国家商品大量 进口,保护其国内产业的重要手段,在未来一段时期内,其对我国纺织产业的影响应该引起 足够的重视;可以肯定的是,以社会责任为内容的企业标准认证终究会被广泛推广。
企业社会责任运动对中国纺织业的挑战
在中国有可能逐步成为国际制造业中心、国内企业与国际市场的联系越来越紧密、中国 外贸依存度超过 60%的背景下,随着发达国家的跨国公司强制推行类似 SA8000 的各种企业 社会责任认证或审核,中国纺织产业发展必将受到严重制约,具体表现在以下四个方面:
(一)企业社会责任运动抵消了配额制逐步取消给中国纺织业带来的市场空间 纺织品配额制的逐步取消已经成为不可逆转的趋势,国际上有人以为中国将是纺织品一体化 的最大赢家。但是,配额制的取消将会刺激以企业社会责任为代表的一系列新的贸易壁垒的 强硬化。企业社会责任与反倾销、反补贴、知识产权壁垒、技术性贸易壁垒和环境保护壁垒 等针对中国的具体条款将不断出现。可以说,配额取消了,但和配额起同样限制作用的条款 增加了,由于企业社会责任相比于反倾销、反补贴等贸易壁垒更具有杀伤力和迷惑性,企业 社会责任将可能是我国纺织品出口的又一个很重要的关坎。
(二)企业社会责任运动导致中国产业升级动力不足 近期沿海发达地区纷纷出现“民工荒”。从珠三角开始、进而波及全国的“民工荒”,已经 成为当前中国的普遍现象,它引发了学术界的一系列检讨性思考,其对纺织业多个层面的影 响将会逐渐显示出来。从目前来看,“民工荒”对企业的生产能力、企业对订单的灵活快速反 应能力、企业的赢利空间都产生了直接的影响。预计下一步国家将会通过修改完善《劳动法》 的方式或各省区出台相关规定来保护劳工的利益, 从而从法制上挤压劳动密集型企业的获 利空间,“逼迫”其产业升级。 同时跨国资本对我国纺织企业的道德认证的要求越来越高。据不完全估计,我国沿海地 区已经有超过 50000 家企业接受根据 SA8000 标准进行的查厂。以上表明,我国出口企业面 临的形式将更为严重。但是跨国公司 FDI 的一个必要条件是:在东道国的生产本钱比国内 低。假如按照目前国际上的企业社会责任标准进步劳动力工资、改善工作条件等,中国纺织 品出口企业就会逐步改变目前主要以劳动力本钱较低吸引外商直接投资的比较上风,结果丧 失利用外资引进先进技术、提升产品结构的可能性,封堵了产业结构升级的主要通道,弱化 外贸对国民经济发展的动态促进作用。 (三)企业社会责任运动降低了中国纺织产业产品的国际市场竞争力 长期以来,“丰富而廉价的劳动力”是中国很多纺织企业获取国际竞争上风的关键,也是 民营纺织企业由小到大、自弱至强发展的原因之一。然而,其背后往往隐躲着恶劣劳作环境、 低薪水平、雇佣童工、加班加点等常见社会题目。一旦发达国家强制要求其进口产品的生产 企业达到相关的企业社会责任标准的要求,达标的过程将使出口生产企业的劳动力本钱明显 上升,国际竞争上风难以为继。首先,最低工资标准一项就足以使生产本钱大幅度攀升。其 次,高昂的认证本钱也让中国很多企业头痛不已。再次,达标过程中出口企业还要耗费很多 时间和精力以及更多的治理用度和本钱。 (四)企业社会责任运动激化中国纺织出口企业已有矛盾 按我国加进 WTO 有关协议的规定,欧美国家在 2005 年 1 月 1 日开始取消我国纺织品 出口配额,国内很多企业出于对国外市场扩大的预期,自 2003 年起便加大了对纺织品产业

的投资,但由于欧美国家出于对纺织业的保护,果断抵制了我国产品的公道出口,终极在 2005 年的下半年达成了逐步削减配额的协议。这对加大的产量能否开释带来很大的压力, 与此同时,随着国际企业社会责任运动的进一步发展,国际社会加大对我国出口纺织企业的 劳工保护等企业社会责任的关注,又将使中国纺织业的发展面临诸多挑战,实在最大的挑战 来自于纺织企业内部。中国纺织产业协会副会长陈树津指出,后配额时代中国纺织业的弱点 主要是:设计研发能力弱,缺乏自主知识产权的原创技术;中高档产品少而“大路货”多,鲜 有国际着名品牌,国内高端市场大多被国外品牌占领;纺织企业众多,但治理水平和信息化 水平落后。而国际企业社会责任运动给我国纺织品企业带来的压力将会使这些原有的交织在 一起的矛盾激化,其结果将使一批较低层次的企业被淘汰出局。

实在,目前跨国公司所要求的众多道德生产守则很多条件跟我国的劳动保护政策有相通 之处。客观地讲,比如 SA8000 也有其公道的成分,作为社会责任方面的一个认证体系,它 不仅明确了企业等组织的社会责任规范,而且也提出了相应的治理体系要求。将社会责任和 治理相结合,在一定程度上可以规范组织尤其是企业的道德行为,有助于改善劳动条件,保 证劳工权益,体现以人为本的思想。企业不应该过于短视,甚至于违法乱纪。就长期而言, 企业社会责任标准会作为一种外力,可从多方面促使企业在追求生产效益的同时,也在环境 保护与劳动保护上下功夫。改善纺织工人的劳动条件,进步治理员工的水平,这样可以提升 产品质量和生产效率,降低本钱。据美国着名运动鞋公司 New Balance 的报告,其在中国 的合约工厂通过实施 SA8000 标准,工作时间减少了,生产率进步了 25%。

对未成年工在劳动保护方面也做出了具体的规定。1995 年 1 月 1 日开始实施《中华人民共
和国劳动法》。在这些法律法规中,对劳动者相关权益的保障规定有些甚至超过了众多跨国
公司道德生产守则或标准的规定。由于中国多数企业,尤其是劳动密集型企业在劳动者权益
保护和企业治理方面长期存在缺陷,甚至最基本的劳动法规都无法得到较好的遵守,由此形
成积弊。因此,国内企业应严格遵守中国现行法律法规,改善劳资关系。这也是我国纺织企

自主沉浮。既便是低端市场也间隔充分开发尚远,这就是美国近期频频要求中国扩大国内市 场开放的原因。我国纺织企业应加大对国内市场的开发力度,切勿一味冲锋陷阵于欧美市场 而忽视了轻而易举可获得的国内市场,尤其是忽视了国内中西部地区的产品开发,后果可能 是得不偿失,由于现在的中西部地区已为承接沿海和东部的产业转移而做好了充足的预备。
同时,要推动出口市场的多样化。发达国家对企业社会责任的要求很严格,往往与我国 作为发展中国家的实际状况不符。而且,美日欧纺织品市场长期以来是我国企业的发展重点。 所以,我国企业应考虑开发周边国家以及非洲国家的纺织品市场。
另外,实施“走出往”战略,跨国经营。国内上风纺织产业企业可以尝试重组和跨国并购, 与国际纺织跨国公司和全球采购团体建立战略同盟。按照规模化、国际化经营模式,逐步形 成一批能直接进进国际主流市场并具有自己名牌产品的跨国企业团体。此外,有实力的企业 还应大胆“走出往”。到中南美、中东、东欧及俄罗斯、非洲、南亚建立纺织生产加工基地, 增强我国纺织企业在国际市场的影响力和控制力,开辟多元化市场空间,从而构建利益互补 和共同繁荣的世界纺织业大市场。
